- Completed work is non refundable. However your project manager may allow considerations if your situation warrants it.
- We offer a 60 day warranty on all web development work. We will fix any bugs within this period free of charge. If any changes or fixes are required after this period the work will be billable at our regular hourly rate.
- Free 15min website updates are for non technical updates only and are provided at our discretion.
- Failure to pay invoices within 30 days may result in your services being disconnected.
- If you the client are unable to allow us to complete your project within a reasonable time-frame (within +20% or 30 days – whichever is less – from the originally estimated project deadline) you may be liable to additional fees to reschedule your project.
If included in your quote the domain type is .com.au. Domain registration other domain extensions are available on request.
As you a probably aware domains are registered rather than purchased. This is akin to leasing a domain name for a set period (usually 2yrs). Re-registering your domain is your (the clients) responsibility and WebDesigners.net.au accepts no liability for expired domains
To ensure your domain is secure we encourage you to register your domain through us as we will send you reminders at 3 months, 2 months, 1 month and 1 week before your domain is due to expire.
WebDesigners.net.au takes no responsibility & provides no guarantees to your domain registration or renewals. Ownership is soley on you the customer to ensure your domain is renewed.
We resell our hosting services via two Australian providers, VentraIP and Panthur. We have carefully selected these companies for their outstanding service, value & reliability. You agree to adhere to both companies terms of service which can be viewed here: panthur.com.au/acceptable-use-policy.php and here: ventraip.com.au/terms-policies-agreements/. By agreeing to these terms you agree to indemnify us of any action taken against us as a result of your breach of our hosting providers terms.
Unless stated otherwise your website hosting package is our standard package which consists of; 500mb data storage & 1gb bandwidth transfer (per month).
Quotes are valid on the basis that you agree to host your website with our company for 12months minimum. After which time your website can be hosted by any provider. If you decide to move providers within this term you agree to pay a cancellation fee consisting of your remaining contract months * your monthly fee. If your remaining contract term is over 6 months your cancellation fee will only be calculated at 6 months.
Some website functionality requires SSL security & dedicated IP addresses, if required these are an additional cost which your project manager will discuss with your prior to proceeding with the website functionality.
If you have opted for “Managed Hosting” your project manager will arrange email address configuration for you but please note we are unable to support 3rd party mail applications such as windows mail or mac mail. We can however give you the necessary settings to allow you to set these up. And provide a reasonable helping hand. If you have opted for “DIY Hosting” you are required to configure your own server we can however provide support for our regular fee
We facilitate a daily backup of all accounts – historical backups are NOT kept so it is HIGHLY RECOMMENDED that you back up your web hosting data periodically so that in the event of a catastrophic failure or your website is hacked you have a current backup to restore your website & data with.
You also agree to keep any server side scripts up to date this includes all open source CMS software such as Joomla or WordPress.
The prices indicated in our quotes (both verbal and written) are specific to the requirements provided by you the client. Any changes to these requirements may result in variance to the above quotation. All additonal fees will be discussed prior to work being completed to ensure there are no unpleasant surprises!
All time frames discussed prior to your project are approximations and various factors can affect these time frames. The nature of our business means that some of these factors are out of our control and as such we (WebDesigners.net.au) can not be held liable for variations in quoted time frames
Projects quoted up to $1000:
Payments are due in 2 instalments 50% upfront and 50% upon website hand over.
Projects quoted greater than $1000:
Payments are due in 3 instalments. 50% upfront, 30% once we’re at the demonstration stage of the website (usually on a testing server and the site is 80% complete) and the final 20% due when we hand the website over.
For the right clients we offer dedicated resources to manage your online business and marketing needs via way of a retainer. These services are by application only and pricing is customised to the specific needs of each client. These fees paid by way of an agreed monthly retainer (payable in advance on the first of each month)
While there are no lock in contracts for retainer services both WebDesigners.net.au and the client are bound by a 30 day termination clause. If either the client or Webdesigners.net.au wish to cease participation in a retainer agreement we agree that:
- Request of termination must be in writing (email is acceptable)
- A fee of one months retainer is payable immediately
- All access to provided services will cease immediately
- Support and warranties for previously rendered services are null and void
Website Design and Development
We will create designs for the look-and-feel, layout and functionality of your web site. This contract includes one main design plus the opportunity for you to make up to two rounds of revisions. If you’re not happy with the designs at this stage, you will pay us in full for all of the work that we have produced until that point and you may either cancel the contract or continue to commission us to make further design revisions at the hourly rate of $80 or as set out in our original estimate.
HTML/CSS layout templates
If the project includes XHTML or HTML markup and CSS templates, we will develop these using valid standards and economical CSS styling. We will test all our markup and CSS in current versions of all major browsers including those made by Apple, Microsoft, Mozilla and Google. We will also test to ensure that pages will display visually in a similar’, albeit not necessarily an identical way. We will not test these templates in old or abandoned browsers, for example Microsoft Internet Explorer 6 for Windows or Mac, previous versions of Apple’s Safari, Mozilla Firefox or Google unless otherwise specified. If you need to show the same or similar visual design to visitors using these older browsers, we will charge you at the hourly rate set out in our original estimate for any necessary additional code and its testing.
We may have written a best-seller but we’re not responsible for writing or inputting any text copy unless we specified it in the original estimate. We’ll be happy to help though, and in addition to the estimate we will charge you at $80 per hour for copy writing or content input.
You will supply us photographs either in digital or printed format. If you choose to buy stock photographs we can suggest vendors of stock photography. Any time we spend searching for appropriate photographs will be charged at $80 per hour.
Changes and revisions
We know from plenty of experience that fixed-price contracts are rarely beneficial to you, as they often limit you to your first idea about how something should look, or how it might work. We don’t want to limit either your options or your opportunities to change your mind.
The quotation prices at the beginning of this document are based on the number of days that we estimate we’ll need to accomplish everything that you have told us you want to achieve. If you do want to change your mind, add extra pages or templates or even add new functionality, that won’t be a problem. You will be quoted for these items at the time to aid in your decision making process. Along the way we might ask you to put requests in writing so we can keep track of changes.
You may already have professional web site hosting, you might even manage that hosting in-house; if that’s the case, great we can package the website up and provide it to your technical personnel to install on your server for a one off fee of $80. If you don’t manage your own web site hosting, we can provide hosting & even website management solutions at a competitive rate. We encourage all clients to utilise our hosting services as we cannot provide support to a website hosted on a third party web server, there are too many environmental issues out of our control to adequately offer support or warranty on the websites function. For sites hosted on our servers we provide a 60 day warranty period in which time we will fix bugs at no cost to you. This warranty covers bugs only which are classified as errors in our code. This does not cover you changing your mind about functionality or design.
Your website may contain software that requires updating periodically. This is particularly true with websites that utilise a CMS (content management system). Failure to update your site software scripts can and quite often do leave your website open to hackers and other malicious acts. It is your responsibility to keep these scripts up to date unless specifically stated otherwise. We offer this service as an add on to your hosting and it is highly recommended.
While every effort is made to test our work we can’t guarantee that the functions contained in any web page templates or in a completed web site will always be error-free and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web site and any other web pages, even if you have advised us of the possibilities of such damages.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed sever-able from this agreement and shall not affect the validity and enforce-ability of any remaining provisions.
You guarantee to us that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the web site are either owned by your good selves, or that you have permission to use them.
When we receive your final payment, copyright is automatically assigned as follows: You own the graphics and other visual elements that we create for you for this project. If requested we can give you a copy of all files. You should store them really safely as we are not required to keep them or provide any native source files that we used in making them.
You also own text content, photographs and other data you provided, unless someone else owns them. We own the HTML markup, CSS and other code and we license it to you for use on only this project. We love to show off our work and share what we have learned with other people, so we also reserve the right to display and link to your completed project as part of our portfolio and to write about the project on web sites, in magazine articles and in books about web design.
